Man alleges Houston law firm used extortion, refused to turn over trust funds, documents to new counsel

HOUSTON — The Simon Law Firm is facing a suit from a former client alleging they mishandled his personal injury case and refused to turn over monies held in a trust and case documents to his new attorney without his signing a liability waiver. 

Sean Sessel filed a pro se complaint Jan, 28 in the Harris County District Court against Kevin Bush, Jonathan Simon and the Simon Law Firm alleging negligence, fraud and breach of contract and breach of fiduciary duty. 

Sessel was injured on Feb. 25, 2019 when he was struck by a car at an intersection in Harris County. He retained the defendants on Feb. 26, 2019 to represent him with his suit.  Sessel claims the defendants failed to provide him with "planned future actions" regarding his case, persuaded him to take a partial distribution settlement with false verbal assurances that he could secure an $8,300 settlement when only $6,700 was offered. Sessel also alleges when he tried to hire new counsel, the defendants attempted to extort release of his trust funds unless he signed a liability waiver.

Sessel seeks monetary relief of more than $80,000, trial by jury and all other just relief.
