Man claims casino falsely arrested, prosecuted him over gambling debt

HOUSTON – A man is claiming a Houston casino falsely had him arrested and prosecuted on charges that were eventually dismissed in order to collect his gambling debt. 

Larry Day filed a complaint Feb. 10 in the Harris County District Court against Pinnacle Entertainment Inc., L'Aubegere Du Lac Hotel & Casino, Christina Gonzales, Larry Robinson, Kirk Houser and others alleging malicious criminal prosecution and negligence.

Day frequented the L'Aubegere Casino in 2005 and 2006. He alleges that he endured "relentless high pressure" to apply for the casino's gaming credit program and eventually fell into debt with his gambling. Day said he was falsely arrested and prosecuted by the casino Oct. 2, 2008, on charges of writing worthless checks that were dismissed. He alleges the casino had no proof of an intent to defraud and that it inflated the value of his unpaid debt. 

Day seeks monetary relief in excess of $1 million, interest, trial by jury and all other just relief. He is represented by Matthew Mussalli of The Matthew Mussalli Law Firm in The Woodlands.
