Woman who suffered fractured pelvis after tripping at Houston retail space claims property owner's negligence

HOUSTON — A woman who tripped over a one-inch post sticking up from the ground at a Houston retail space and fractured her pelvis is claiming the property owner's negligence. 

Roberta Miles Kressler filed a complaint Feb. 13 in the Harris County District Court against BWIN Investment LTD alleging negligence. 

Kressler was walking on the sidewalk in front of the retail spaces owned by BWIN on Westheimer Road in Houston on Sept. 6, 2019. She alleges that she tripped over the "remains of a post" that had been removed that had about inch sticking up out of the cement. Kressler claims she suffered injuries to her hip and a fractured pelvis. She alleges BWIN failed to inspect and maintain a safe premises. 

Kressler seeks monetary relief in excess of $200,000, trial by jury, interest and all other proper relief. She is represented by Mark Weycer of The Weycer Law Firm PC in Bellaire.
