Man injured after delivery worker falls off trucks, lands on him -- sues Lowes

HOUSTON — Lowes and others are facing a suit by a man claiming he was injured when a worker fell out of the back of a delivery truck while unloading his new refrigerator.

James Mason filed a complaint Feb. 17 in the Harris County District Court against XPO Last Mile Inc., LMV & YIH South West LLC and Lowes Home Centers LLC alleging negligence.

Mason purchased a refrigerator from Lowes who enlisted XPO and LMV & YIH South West to deliver. He alleges that while XPO and LMV & YIH South West workers were unloading the refrigerator, one of the workers lost his footing and fell off the back of the truck and landed on him. Mason claims he suffered "severe" injuries as a result of the accident and that the defendants failed to provide proper training and monitoring of its employees. 

Mason seeks monetary relief of more than $74,999.99, interest, trial by jury and all other just relief. He is represented by Jack Ivey and Jacob Barber of The Ivey Law Firm PC in Houston.
