Couple sues K. Hovnanian after finding toxic mold in their home

HOUSTON — A couple is suing the builder of a seven-year-old home they purchased in Tomball after discovering toxic mold intrusion.  

John Tomaszewski and Heather Bryan filed a complaint Feb. 21 in the Harris County District Court against K. Hovnanian of Houston II, LLC doing business as Brighton Homes and Houston Roofing & Construction LLC alleging violation of the Texas Deceptive Trade Practices Act and breach of implied warranty.

The plaintiffs purchased a residence on May 10, 2016 that was built in 2013 by Brighton. The residence included a home builder's warranty that was transferred to them through the purchase. They allege in the summer of 2019, they discovered toxic mold intrusion in the home with the defendants refusing to reimburse them for mold remediation expenses.

The plaintiffs seek monetary relief of no less than $139,996.65, trial by jury and all other just relief. They are represented by Thane Sponsel, III and Zachary Clark of Sponsel Miller Greenberg PLLC in Houston.
