Man alleges debt collector hinder his rights under FDCPA

TYLER — A man is alleging an Illinois-based debt collection company attempted to hinder his rights under the Fair Debt Collection Practices Act (FDCPA) regarding his debt with AT&T. 

Martin Barnard filed a complaint Feb. 25 in the Tyler Division of the Eastern District of Texas against Afni Inc., alleging violation of the FDCPA.

Barnard had incurred debt with AT&T. He alleges that on June 17, 2019, Afni contacted him in an effort to collect the debt. Barnard claims the Afni representative gave him false information regarding his consumer rights and attempted to hinder his rights under the FDCPA. He also alleges the representative was "rude and condescending" while trying to deny his right to dispute the debt. 

Barnard seeks monetary relief, trial by jury and all other just relief. He is represented by Samantha Orlowski and Joel Halvorsen of Halvorsen Klote in St. Louis, Missouri.
