BEAUMONT - A lawsuit alleging a dog attack was recently filed.

Seeking up to $100,000 in damages, Karen Hodges filed suit against Betty Ann Cheek and her family on Feb. 12 in Jefferson County District Court.

According to the lawsuit, on Sept. 21 Hodges’ child was playing in the yard of a household they were visiting when dogs owned by Cheeks began running towards the minor.

“Two of the dogs stopped before reaching her, but one … continued chasing and upon reaching the minor bit her,” the suit states. “The condition of Defendants’ premises and their lack of control over the dogs created an unreasonable risk of harm…”

The suit states the dogs were allowed to roam freely without a means of restraint or barrier between them and the public and that it is believed that the dogs have bitten other people prior to the incident.

The plaintiffs are seeking damages for medical expenses, pain, mental anguish and impairment.

They are represented by Adam Terrell, attorney for the Weller, Green, Toups & Terrell law firm in Beaumont.

Judge Mitch Templeton, 172nd District Court, has been assigned to the case.

Case No. E-205337
