Man who suffered traumatic brain injury after being ejected from company truck claims negligence

WACO — A man who suffered a traumatic brain injury after being ejected from a company truck driven by a co-worker whose licensed had been revoked is claiming negligence. 

Christopher Deitz filed a complaint Feb. 26 in the U.S. District Court for the Western District of Texas Waco Division against Performance Food Group Inc., doing business as Performance Foodservice-Temple, TX., alleging negligence. 

Deitz, who was employed by Performance Food was off duty on Jan 6, 2019 while on the company's premises. He alleges that while sitting in the back of a Performance Food pick up truck driven by a fellow employee to take an item to the dumpster, he was ejected, hit his head on the ground and was knocked unconscious. Deitz suffered a permanent, traumatic brain injury and alleges the driver of the company's truck had his licensed revoked twice and had a criminal record.

Deitz seeks monetary relief of more than $75,000, trial by jury, interest and all other just relief. He is represented by Sean Breen, Randy Howry and Christopher Lavorato of Howry Breen & Herman LLP in Austin.
