Dog day care owner faces suit alleging illegal employee tip-pooling

SAN ANTONIO — Dogtastic dog day care and its owner are facing a suit alleging illegal tip-pooling of its employees. 

Hunter Jones and Alexandra Rivera, each individually and on behalf of all others similarly situated, filed a complaint Feb. 26 in the U.S. District Court for the Western District of Texas San Antonio Division against Dogtastic LLC, Kimberly Smith and Michael Mitchell alleging violation of the Fair Labor Standards Act (FLSA). 

Jones is currently employed by Dogtastic and Rivera worked for Dogtastic from November of 2019 through February of 2020 with both working as dog care specialists at Dogtastic's Pawderosa Ranch. They allege that Dogtastic took their tips and redistributed them among three department heads in violation of the FLSA's tip pool requirements.
