Former Five Oaks Achievement Center employees allege "sleep time" was illegally deducted from pay

HOUSTON — Former Five Oaks Achievement Center employees are alleging the center illegally deducted "sleep time" from their pay without meeting federal law requirements. 

Devery Davis and Clifton Humphrey, individually and on behalf of all others similarly situated filed a complaint  Feb. 28 in the Houston Division of the Southern District of Texas against Five Oaks Achievement Center LLC doing business as Five Oaks Achievement Center and others alleging violation of the Fair Labor Standards Act. 

Davis and Humphrey worked for Five Oaks as a "direct care" employee between 2011 and 2018. They allege that they worked more than 40 hours each week and that Five Oaks deducted an eight hour sleep time period from direct care staff workers pay without providing requirements such as sleep facilities and five hours of "uninterrupted sleep" each night. 

The plaintiffs seek monetary relief, interest and all other proper relief. They are represented by Mickey Washington and Kimberly Bennett of Washington & Associates PLLC in Houston.
