Man claims contractor placed invalid lien on his property after he was fired for defective work

HOUSTON — A man is claiming a contractor filed an invalid lien on his property after he fired him for defective remodeling work.

Jake Burkland and L. Carlene Burkland filed a complaint March 1 in the Harris County District Court against Re-Model Enterprises Inc., doing business as Re-Model Inc., and Eric Vasquez alleging breach of contract and violation of the Texas Deceptive Trade Practices Act. 

Burkland received an estimate from Re-Model in September of 2017 for remodeling work due to flood damage at his Pasadena home. He alleges that he had verbal agreement with Re-Model to perform the work for $106,519.25. Burkland claims the work done by Re-Model was defective including an improperly installed shower, wrong tile, improperly cut door jambs and windowsills and other defects. He alleges he terminated the oral contract on March. 3, 2018, with Re-Model then filing an invalid lien on his property. 

Burkland seeks monetary relief between $200,000 and $1 million, interest and all other just relief. He is represented by Joanne Ericksen of The Ericksen Law Firm PLLC in Houston.
