Former Big Lots employee claims he was not granted physician ordered restrictions after on-the-job injury

GALVESTON — Big Lots is facing a suit by a former employee claiming he was not granted his physician ordered restrictions after suffering an on-the- job injury. 

Joaquin Victoria filed a complaint March 3 in the Galveston County District Court against Big Lots Stores Inc., and Joshua Wagner alleging negligence. 

Victoria worked for Big Lots and was unloading a delivery truck on March 6, 2018. He alleges that while unloading the truck, a case of dog food that improperly loaded, fell on his upper body. Victoria claims he suffered injury to his head, neck and shoulders. After seeking medical care, Victoria was given restrictions by his physician which included no lifting, climbing ladders or carrying items over 10 pounds. He alleges that his supervisor, Wagner, did not grant him his restrictions and held him to his normal job duties which caused further injuries.

Victoria seeks monetary relief between $200,000 and $1 million, trial by jury, interest and all other just relief.  He is represented by Michael Downey of Mostyn Law in Houston.
