Woman claims homebuilder, subcontractors she paid more than $4 million did defective work, abandoned job

HOUSTON — A woman who paid a home builder more than $4 million to build a home on her ranch near Cuero claims the builder and its sub- contractors did defective work and abandoned the job. 

Patricia Muir filed a complaint March 2 in the Harris County District Court against Horizon Mill Works Inc., S4 Irrigation, Spear Paint Contracting, Zimmerman Electric, Associated Marble and others alleging negligence, breach of contract and breach of implied warranty of good & workmanlike services, fraud and violation of the Texas Construction Trust Fund Act. 

Muir hired Horizon in August of 2017 to build a home on her ranch near Cuero. She alleges that between November of 2017 through August of 2019, she has paid Horizon a total of $4,066,785.62 with Horizon and its subcontractors providing defective work and abandoning the project. Muir claims the defective work included improperly installed cabinets and trim, windows and doors, masonry, and defective roofing, gutter systems, flooring and plumbing. 

Muir seeks monetary relief, trial by jury, interest and all other just relief. She is represented by James Foley of The Weaver Law Firm in Houston.
