Jefferson County jury awards no damages in med-mal, plaintiff sought more than $1M in damages

BEAUMONT – A medical malpractice lawsuit recently concluded with a no negligence verdict.

Seeking more than $1 million in damages, Katherine Campbell filed suit against Gulf Coast Cardiology Group, Dia Abochamh, and Mohammed Islam on Dec. 30, 2016.

According to the lawsuit, in January of 2015 Campbell had a percutaneous transluminal angioplasty, a procedure that can open up a blocked blood vessel using a balloon, performed on her.

During the procedure and follow up visit, the defendants’ conduct allegedly fell below the standard of care.

As required by the Texas Civil Code, Campbell submitted an expert report, authored by a Dr. Sumita Chowdhury, to substantiate her claims.

Court records show Gulf Coast Cardiology and Dr. Abochamh filed an objection to the report on Feb. 17, 2017, asserting that Dr. Chowdhury’s report fails to establish that she is qualified and that her report is conclusory, failing to explain how any alleged breach in care caused Campbell’s injury.

When the case finally went to trial in late February, the jury was asked if Dr. Abochamh was negligent, to which they answered “No,” according to the charge of the court.

Campbell was asking the jury to award her damages for her medical expenses, pain, mental anguish, impairment, disfigurement and loss of earning capacity.

Campbell is represented by Mark Sparks of The Ferguson Law Firm in Beaumont.

Judge Baylor Wortham, 136th District Court, presided over the trial.
