HOUSTON — A man is suing Capital One Auto Finance claiming they continued to make collection calls to his cell phone after he requested the calls to stop.
Tommy Beatty filed a complaint March 19 in the Houston Division of the Southern District of Texas against Capital One Auto Finance Inc., alleging violation of the Telephone Consumer Protection Act and Texas Debt Collection Act.
Beatty claims in his complaint that Capital One Auto Finance began calling him on his cell phone to collect an alleged debt. He alleges that despite his requests for the calls to stop, they continued to call him using a telephone dialer system.
Beatty seeks monetary and all other just relief. He is represented by Michael Agruss of The Agruss Law Firm LLC in Chicago.
