Attorney squabble over fees from Brownsville ISD defect suit ends up in court

HOUSTON – A dispute over attorney’s fees stemming from a construction defect lawsuit has made its way to court.

On April 6, Norman and Michael Jolly filed a petition for declaratory judgment against Martie Garcia-Vela and Daniel Garcia, along with the attorneys’ respective firms, in Harris County District Court.

According to the petition, the defendants are “falsely” alleging and demanding attorney’s fees are owed to them by way of a construction defect lawsuit brought on behalf of Brownsville ISD.

“Plaintiffs dispute any attorney fees are owed to defendant,” the petition states. “Plaintiffs seek a determination of the validity, obligations, and construction of any attorney fee joint enterprise agreement(s) between the parties and obtain a declaration of the rights, duties, status or other legal relations related thereto.”

Houston attorney Hamilton Rucker represents the plaintiffs.
