BEAUMONT – After suddenly being slammed into and run off the road, Marsha Stephens and her minor child were able to escape their vehicle before it caught fire.
On May 7, Stephens filed suit against Alon Del Mosley, the driver who allegedly caused the collision, along with the man’s employer at the time, Midstream Transportation.
According to the lawsuit, on Feb. 10 Stephens and her son were traveling in Chambers County when Mosley “failed to pay attention” and changed lanes when unsafe, smashing into Stephens’ vehicle.
“The impact caused Plaintiff’s vehicle to leave the roadway and spin out into a ditch,” the suit states. “Plaintiff was lucky to escape her vehicle with her minor son before her vehicle caught fire.”
Mosley was in the course and scope of his employment with Midstream at the time of the collision.
State Farm Mutual Automobile Insurance is also named as a defendant, as the plaintiffs are seeking to recover underinsured motorist benefits.
The plaintiffs are alleging gross negligence and seek to recover more than $1 million in damages.
