Woman takes a step backwards and trips, sues Walmart for exemplary damages

HOUSTON – While waiting for a TV, Maria Ibarra took a step backwards and tripped.

On May 12, Ibarra filed suit against Wal-Mart Stores Texas, seeking exemplary damages for her trip and fall injuries.

According to the lawsuit, on Nov. 22, 2018, Ibarra was shopping at a Houston Walmart when she was allegedly injured.

“While she was waiting for an employee to retrieve a television for her, she took a step backwards and tripped over a dolly that had been left in the walkway,” the suit states.

Ibarra is accusing Walmart of negligently failing to provide workers with proper training and warn her of the unreasonably dangerous condition.

She contends Walmart was grossly negligent, entitling her to exemplary damages.

She is also suing for her past and future medical expenses, mental anguish, impairment and disfigurement.

Houston attorney Sofia Bruera represents her.

Filed in Harris County District Court, case No. 2020-29106.
