Widow, children of dead CEMEX construction worker seek $1 million in negligence suit

HOUSTON — The widow and children of a CEMEX Construction worker who was killed in a workplace accident at the company's mine is seeking more than $1 million in a negligence suit.

Ana Guiermina Flores Garza, individually and as next-of-friend of A.G.D.R. and A.R.D.F., minors, and as representative of the Estate of Jesus Rene Dominguez Herrera and Angel Abelardo Dominguez Faz and Gabriela Abigail Dominguez Faz, individually and as next friends of J.R.D.F., a minor, filed a complaint May 22 in Harris County District Court against CEMEX Construction Materials South LLC, alleging negligence. 

Jesus Rene Dominguez Herrera was working as a contractor at CEMEX's Balcones Quarry Mine facility on Wald Road in New Braunfels on March 7, 2019. The plaintiffs allege that while changing the drive belts on a log washer motor, Herrera lost his balance and fell back 12 feet into a gap between two log washers and landed on a cable tray. The plaintiffs also claim Herrera was not wearing any "fall protection" at the time and that CEMEX failed to have a supervisor at the scene where Herrera was working or to train and warn its workers of dangers.

The plaintiffs seek monetary relief of more than $1 million, trial by jury, interest and all other just relief. They are represented by Raul Steven Pastrana and Cristina Garcia Chappell of the Pastrana Law Firm in Austin.
