Schlitterbahn sued after worker dies from heat stress - family seeks more than $1M in damages

HOUSTON – A little over a year ago, Jose Toledo was working for Schlitterbahn in hot conditions when he started to suffer from heat stress and died.

On June 10, Toledo’s family filed suit against Waterpark Management (Schlitterbahn), seeking more than $1 million in damages.

According to the lawsuit, on May 22, 2019, Toledo was working outside for Schlitterbahn in hot conditions. He and others were preparing a portion of the kiddie-area of the park for painting.

“After returning to work from a lunch break, Toledo and other Schlitterbahn employees began painting the kiddie area,” the suit states. “Toledo began exhibiting visible signs of heat stress. Toledo’s heat stress continues to worsen until he succumbed to the heat-related illness.

“As a result, forty-five year-old Toledo died.”

The suit accuses Schlitterbahn of negligently failing to monitor Toledo for signs of heat stress and train all employees of its dangers.

The plaintiffs are suing for wrongful death damages.

They are represented by attorney Adam Voyles of the Houston law firm Lubel Voyles.
