HOUSTON — A Harris County woman is suing a Houston auto dealership alleging she received illegal telemarketing calls on her cell phone from the dealership.
Tasha Jackson, individually and on behalf of all others similarly situated, filed a complaint June 3 in the Houston Division of the Southern District of Texas against South Houston Motorcars LLC doing business as South Houston Nissan alleging violation of the Telephone Consumer Protection Act.
Jackson alleges in her complaint on Dec. 14, 2019, she received "a prerecorded telemarketing call" on her cell phone. She claims the recording was a person who identified himself as South Houston Nissan's general manager who was advertising the dealership's "year end clearance event." The message also stated Jackson would be eligible to receive a free flat screen TV and other prizes if she purchased a vehicle from the dealership. Jackson claims she never gave "express consent" to be contacted on her cell phone for marketing calls.
Jackson seeks monetary relief, trial by jury and all other just relief. She is represented by Angelica Gentile of Shamis & Gentile PA in Miami, Scott Edelsberg and Michael Eisenband of Edelsberg Law PA in Aventura and Ft. Lauderdale, Manuel Hiraldo of Hiraldo PA in Ft. Lauderdale and Ignacio Hiraldo of IJH Law in Miami.
