Texas drywall business faces negligence claim from worker who fell off scaffold

HOUSTON — A Texas drywall business is facing a negligence suit by a former worker who fell more than six feet off a scaffold while painting ceilings at a new construction job site. 

Jonathan Ortega filed a complaint June 23  in Harris County District Court against E. Villarreal Enterprises LLC doing business as Villarreal Drywall alleging negligence.

Ortega was working for Villarreal Drywall on April 8, 2020, at a new commercial building job site in Richmond. Ortega alleges in his complaint that he was assigned to paint the ceilings in the building and that while on the scaffold, he tripped and fell more than 6 feet. Ortega claims he suffered "severe injuries" as a result of the fall and that Villarreal failed to provide a safe work environment. He also claims Villarreal failed to put safety practices in place or warn him of the hazards of his duties. Ortega states in his suit that as a result of his fall, he endured medical treatments and costs as well as suffered pain, mental anguish, impairment and disfigurement. 

Ortega seeks monetary relief of more than $1 million, trial by jury, interest and all other just relief. He is represented by Roy Elizondo, III of The Law Offices of Domingo Garcia LLP in Houston.
