Youth sports nonprofit in Cypress claims company they paid more than $150,000 left projects unfinished

HOUSTON — A nonprofit youth sports organization in Cypress is claiming they paid a company more than $150,000 for projects that were left uncompleted.

Fairfield Sports Association Inc. filed a complaint July 10 in Harris County District Court against Kynn Knight, doing business as Premierscape Services LLC, and also as Diamond K Services TX and Larry Gattis, doing business as Premierscape Services LLC, alleging breach of contact, unjust enrichment and fraud.

According to Fairfield Sports' complaint, the nonprofit, which provides organized youth sports programs in the Cypress area, hired the defendants for five "capital projects" and field maintenance.  

The jobs included a fence and concrete pad installation at Weaver Park, a concrete pad at Central Park, a new metal building, removal of a tree, installation of a batting cage and Schiel aerating and top dressing. Fairfield alleges it paid the defendants a total of $150,035 from Jan, 10, 2019, through June 21, 2019. 

Fairfield claims the defendants misrepresented the projects' completion dates and left projects unfinished despite keeping their payments. Fairfield also claims the defendants stated in writing on Oct. 14, 2019, that they would return the money but have yet to refund the payments.

Fairfield seeks monetary relief between $100,000 and $200,000, interest and all other just relief. They are represented by Frank Daniel of The Frank Daniel Law Firm PLLC in Cypress.
