HOUSTON – A slip and fall at the Marshalls on South Gessner has resulted in a lawsuit seeking up to $70,000 in damages.

Nohelia Macareno filed suit against Marmaxx Operating Corp. on July 15 in Harris County District Court.

According to the lawsuit, on June 29, 2019, the plaintiff was waking through the store when she slipped on an oily substance leaking from a broken bottle on the floor.

“Clearly, at least one of Defendant’s employees was aware of the dangerous condition as Defendant’s employee told Plaintiff that another of Defendant’s employees had been assigned to clean up the broken bottle and oil,” the suit states. “Despite this knowledge, Defendant neither made the area safe nor warned invitees.”

The plaintiff is suing for her past and future medical expenses, pain, mental anguish, impairment and lost wages.

She is represented by the Houston law firm of Mestemaker, Straub & Zumwalt.
