HOUSTON — A job applicant who was injured when she tripped over a chair at St. Luke's Medical Clinic is claiming negligence.

Bernice Horton filed a complaint July 16 in Harris County District Court against Chi St. Luke's Health Baylor College of Medicine Medical Center doing business as Baylor St. Luke's Medical Center alleging negligence.

Horton was interviewing for a position at St. Luke's Medical Clinic on Jan. 2, 2019. She alleges in her complaint that she tripped and fell over "uneven legs" on a chair as she was getting up and suffered permanent injuries. Horton, who was 48 years old at the time of the alleged accident, claims her injuries include mental and physical pain, disfigurement and loss of her capacity "to perform household services." Horton alleges St. Luke's was negligent for failing to prevent the fall and allowing the hazard to exist. She also claims St. Luke's was negligent in failing to warn of the tripping hazard.

Horton seeks monetary relief between $200,000 and $1 million, trial by jury, interest and all other just relief. She is represented by Jeffrey Todd of The Todd Law Group in Houston.
