Former carpenter at Houston company claims he was not paid for overtime in violation of FLSA

HOUSTON — A Houston-based commerical interior construction company, Drake Interiors, is facing a claim it failed to pay its employees overtime in violation of the Fair Labor Standards Act (FLSA). 

Lucio Gomez, individually and on behalf of all others similarly situated, filed a complaint Aug. 3 in the Houston Division of the Southern District of Texas against Drake Interiors Inc., alleging violation of the FLSA. 

According to the class action complaint, Gomez was employed by Drake Interiors from Oct. 2019 through May 2020 as a carpenter. Gomez's job included cutting, shaping and installing building materials and he was paid on an hourly basis, "in cash" each week. 

He alleges he worked more than 40 hours per week but was not paid overtime. Gomez claims he was paid the "same rate of pay for all of the hours he worked" despite being exempt from the FLSA maximum hour requirements. 

He also cliams that Drake Interiors' actions "willfully violated" the FLSA and that the company has a history of unlawful pay practices and was the subject of "internal investigations." He also claims he and other Drake employees "have been victimized" and are entitled to back wages. 

Gomez seeks monetary relief, interest and all other just relief. He is represented by Melissa Moore of Moore & Associates in Houston.
