Houston residents claim debt collector for online lender violated state, federal laws

HOUSTON — Two Houston residents have filed suit against a debt collection company claiming they violated federal and state debt collection laws relating to a loan from an online lender. 

Fallon Cooksey and Billy Washington filed a complaint  Sept. 14 against Global Trust Management LLC in the Houston Division of the Southern District of Texas alleging violation of the Fair Debt Collection Practices Act (FDCPA) the Telephone Consumer Protection Act (TCPA) and the Texas Debt Collection Act (TDCA). 

According to the complaint, Washington received a loan from Check n' Go which he defaulted on and owed a balance of $468.84. The plaintiffs allege that Cooksey began to receive dozens of "unwanted, unauthorized, unconsented-to" calls from Global Trust Management on her cell phone in their effort to collect on Washington's debt. 

Cooksey claims she asked Global Trust to "remove this number" and also requested they remove the number three months prior. The plaintiffs also claim that written correspondence received from Global Trust in January of 2020, "did not afford" Washington notice of his rights per the FDCPA. 

The plaintiffs also allege the debt collection practices "diminished value and utility of telephone equipment and telephone subscription services" and caused "emotional distress" and distraction. 

The plaintiffs seek monetary relief, trial by jury and all other proper relief. They are represented by Mohammed Badwan and Victor Metroff of The Sulaiman Law Group LTD in Lombard, Illinois.
