HOUSTON — Texas-based IZ Cash is facing a class action alleging the company failed to pay its cashiers for time worked passed their shift and illegally deducted cash box shortages from their pay.
Dayanna Aboin, individually and on behalf of all others similarly situated, filed a complaint Sept. 14 in the Houston Division of the Southern District of Texas against IZ Cash alleging violation of the Fair Labor Standards Act (FLSA).
According to her complaint, Aboin worked as a cashier for IZ Cash from July 2018 through August 2020 and was classified as a "full-time, non-exempt employee." She alleges that she and other cashiers were required "to come in" prior to their "scheduled shift" to "gather and organize" money for their cash box. Aboin also alleges cashiers were required to "stay at work after their scheduled shift" to balance the cash box and do paperwork."
She claims the boxes were not locked or secured in any way and that they were often left unattended during breaks that resulted in the boxes being short. Aboin also claims on Aug. 14, 2020, her cash box was $2,000.10 short which required her to stay two hours past her scheduled shift.
She alleges the cashiers were not paid for any of the time worked past their shift and that without proof, criminal charges or allowing her to review the security camera footage, she was required to have the cash shortage deducted from her paycheck which dropped her below the minimum wage.
Aboin seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Genevieve Estrada of Alonso & De Leef PLLC in Houston.
