Former project engineer with PSRG claims the company failed to pay workers for overtime

HOUSTON — A health and safety staffing company for the oil and gas industry is facing a claim they failed to pay employees overtime wages.

Rashid Hamsayeh, individually and for others similarly situated, filed a complaint Sept. 17 in the Houston Division of the Southern District of Texas against PSRG alleging violation of the Fair Labor Standards Act (FLSA).

In his complaint, Hamsayeh alleges that during his employment with PSRG as a project engineer from December 2019 through March 2020, he "routinely" worked five, 10-hour shifts in a week without being paid for overtime. 

He also claims that while performing his job duties of ensuring employee and contractor compliance with the company's safety protocols, he often worked as much as six to seven 10-12 hour shifts and more than 70 hours per week but was only paid "straight-time" and not a "guaranteed salary." Hamsayeh alleges that he and "dozens" of other PRSG employees suffered lost wages due to PSRG's "payment scheme" which is in violation of FLSA. 

He also alleges PSRG's "systematic policies and practices" and failure to pay overtime wages has caused him and the class to suffer damages.

Hamsayeh seeks monetary relief, trial by jury, interest and all other just relief. He is represented by Michale Josephson and Andrew Dunlap of Josephson Dunlap LLP in Houston and Richard Burch of Bruckner Burch PLLC in Houston.
