Bakery faces claim it failed to pay workers for overtime

SHERMAN — A Flower Mound, Texas bakery is facing a claim that it failed to pay workers for overtime. 

Maria Ibarra and all others similarly situated under 29 U.S.C. 216(B), filed a complaint Oct. 5 in the Sherman Division of the Eastern District of Texas against Redstone LLP doing business as Swirl Bakery and Chris Norwood alleging violation of the Fair Labor Standards Act (FLSA) and breach of contract.  

According to her complaint, Ibarra began working for Swirl Bakery owned by Norwood in July of 2013. She alleges that she worked "an average" of about 50 to 90 hours per week and was compensated through "straight time pay" of  $9.75 to $13.00 per hour but never received overtime pay.  Ibarra also alleges that Swirl did not pay her for all of the hours she worked each week either through a regular wage or with overtime pay. 

She claims Swirl and Norwood "willfully and intentionally" refused to pay her and other bakery workers overtime wages and that those actions have resulted in violating the (FLSA). Ibarra also claims the defendants breached an oral agreement that she would be paid wages for her work and that she was "shorted" on her paychecks. 

Ibarra seeks monetary relief, interest, trial by jury and all other just relief. She is represented by Thomas Urquidez of The Urquidez Law Firm LLC in Dallas.
