HOUSTON - Duane Morris LLP filed an application for writ of garnishment against Menger Valve LLC yesterday.
Court records show that on April 24, 2019, Mark Menger filed suit against Morris and several other individuals and entities.
On Jan. 6, a trial court granted Morris’ motion for summary judgment on its counterclaim for breach of contract. On Feb. 18, the court granted Morris’ motion for award of attorneys’ fees, motion to sever claim and motion for final judgment.
On June 25, Morris recorded an abstract of judgment against Menger in the principal sum of $153,732.26 in actual damages, $22,490 in attorneys’ fees and $262 in costs, plus pre and post judgment interest at 5 percent.
“The judgment is in all things final, valid, subsisting, and it is wholly unsatisfied and unpaid,” the application states. “Within Duane Morris’ knowledge, Menger does not possess exempt property in Texas subject to execution sufficient to satisfy the judgment.
As such, Duane Morris seeks a Writ of Garnishment against Menger Valve because Duane Morris has reason to believe, and does believe, that Menger Valve possesses property belonging to Menger or is indebted to Menger
