GALVESTON — Home Depot is facing a complaint by a customer alleging she tripped and fell over a pallet jack that was left near the end of an aisle at a store in Alvin.
Maria Torreros filed a complaint Oct. 14 in the Galveston County District Court against Home Depot U.S.A., Inc., alleging negligence.
Torreros claims in her suit that on Nov. 24, 2018, when she was shopping at the Home Depot in Alvin, she was "severely injured" when she tripped over the forks on a pallet jack as she walked into the main aisle. She alleges the pallet jack was left "at the end of an aisle" near a "aisle cap where it wasn't visible" which caused her to trip and fall. Torreros claims she suffered "serious and lasting injuries" that have resulted in medical expenses, physical impairment, mental anguish and loss of earning capacity.
She alleges Home Depot was negligent in failing to "properly inspect and maintain the premises," and in failing to give "adequate and understandable warnings" regarding an unsafe condition. She also alleges the "condition existed despite the fact that the defendant or defendant's agents" knew of its existence as well as the "likelihood of a person being injured."
Torreros seeks monetary relief, interest and all other just relief. She is represented by Jared Ynigez and C. Alexander Higginbotham of The Law Office of Jared B. Ynigez PLLC.
