Galveston company alleges contractor's negligence installing HVAC systems led to water, moisture damage

GALVESTON — A Galveston company is alleging a contractor's negligence in installing HVAC systems led to more than $30,000 in water damage and moisture repairs. 

39120 Enterprises Inc., filed a complaint Oct. 19 in the Galveston County District Court against James Turner Construction LTD alleging breach of contract. 

According to the complaint, 39120 Enterprises entered into a contract with James Turner Construction on Sept. 1, 2017, for "residential improvements" to their property on Sealy Avenue Galveston. The plaintiff alleges that after the construction work was completed, problems with leaks and accumulation of moisture were discovered in and around the ceilings of two "newly constructed" residential units. 

They also allege that "several months" after bringing the issues to the attention of the defendant, they "failed to identify or repair the source of the accumulation of moisture." The plaintiffs claim that an investigation found the moisture was from the heating, ventilation and AC systems being "improperly sized and installed." They also claim the piping of the systems were damaged during installation. 

The plaintiff states they have suffered $3,000 in diagnostic and repair costs, $12,000 for water and moisture removal, $7,754 for sheet rock and baseboard demolition, $3,706 for flooring replacement, $2,950 for plumbing fixtures and appliance replacement and $4,000 for hardwood floor cleaning and repair. 

The plaintiff seeks monetary relief of more than $100,000 and all other just relief. They are represented by Attorneys Thomas McQuage and Billy Williams, Jr., in Galveston.
