Texas debt collection company accused of excluding required information in 'demand letter'

HOUSTON — A Texas consumer debt collection company is being accused of using false and misleading representations by not including required information in their "demand letter.

Kirsten Haack filed a complaint Oct. 28 in Harris County District Court against ProCollect Inc., alleging violation of the Texas Debt Collection Act, Texas Deceptive Trade Practices Act.

Haack claims in her suit that on Oct. 15, 2019, ProCollect, a third party debt collector, mailed her a collection letter. She alleges the letter did not contain the required information including a statement regarding dispute and validity of the alleged debt. 

Haack also alleges the letter did not contain the required statement regarding verification of the debt and her receiving a copy of the judgement or a statement regarding her write to send a written request to ProCollect to provide her with the name and address of the original creditor, if different from the current creditor.

Haack seeks monetary relief, trial by jury and all other just relief. She is represented by Attorney Douglas Hamel in Houston.
