HOUSTON — A man claims his BMW required an engine replacement after an oil change shop used the incorrect oil and short-circuited the electrical system.
Michael Garcia filed a complaint Nov. 10 in Harris County District Court against T5 Oil Change LLC alleging breach of contract, breach of duty of good faith and fair dealing, violation of the Texas Deceptive Trade Practices Act and fraud.
According to the complaint, Garcia took his 2015 BMW M4 to the Take 5 store on Rayford Road in Spring for a cabin filter replacement and oil and and oil filter change. He alleges that while replacing the cabin filter on his vehicle, the defendants caused "an arc to the electrical control unit" by not "grounding first as required by the vehicle for this operation."
He also alleges the defendants failed to use the incorrect "viscosity oil" that was indicated on his service paperwork. Garcia claims the defendant's alleged "substandard and improper repair" of his car caused his vehicle to need a full engine replacement and repairs estimated at $35,000.
Garcia claims the Take 5 owners have denied liability for the problem despite a third party vehicle repair business and lab confirming the wrong oil was placed in his vehicle.
Garcia seeks monetary relief, trial by jury, interest and all other just relief. He is represented by Nicholas Saranto of Sarnanto Law in League City.
