Man alleges he suffered injuries after slipping at Wendy's

HOUSTON — A man claims the manager of a Wendy's was aware of an alleged liquid substance on the floor that caused him to allegedly slip and suffered injuries.  

Gayland Freeman filed a complaint Nov. 10 in Harris County District Court against Haza Foods LLC doing business as Wendy's Company.

Freeman alleges in his complaint that on June 22, 2019, he was visting the Wendy's on East Sam Houston Parkway in North Houston when he slipped and fell on a "liquid substance" that accumulated on the floor. 

He claims that "at least one" of the Wendy's employees was aware of the "dangerous condition" because the restaurant manager "spoke with another employee about being told to clean the area affected earlier." 

Freeman claims Wendy's failed to warn of the dangerous condition which he alleges caused him to suffer pain, mental anguish and lost wages. He also claims he has incurred medical expenses as a result of his alleged injuries.

Freeman seeks monetary relief, trial by jury, interest and all other just relief. He is represented by David Mestemaker, Norman Straub and Jonathan Zumwalt of Mestemaker, Straub & Zumwalt in Houston.
