Woman claims she found 'Benadryl-type' pill in her Whataburger

HOUSTON —  A woman claims she found a "Benadryl-type" pill stuffed in her Whataburger meal and became "violently ill." 

Marquita Love filed a complaint Nov. 10 in Harris County District Court against Whataburger Inc., alleging personal injury.

According to her complaint, Love ordered a meal from Whataburger located on Sam Houston Parkway in West Houston on May 7, 2020. She alleges that when she opened the burger's foil wrapper, a "Benadryl-type pill" had been placed inside the burger. 

Love also alleges that when she informed the manager about the alleged pill in her burger, he stated "oh no this happened again." Love states in her suit that 48 hours later, she became "violently ill" and had to be treated in the ER. 

She claims the defendant has refused to compensate her for her damages including for medical expenses. Love also claims she has suffered physical pain, impairment and mental anguish.

Love seeks monetary relief, trial by jury, interest and all other just relief. She is represented by Nicholas Saranto of Saranto Law in League City.
