HOUSTON – A man claimed he suffered injuries after falling over a crack in the sidewalk alongside an AM Mini Mart gas station in Houston.
Jeremey Humphry filed a complaint on Dec. 10 in Harris County District Court against Sydni Inc., doing business as AM Mini Mart, alleging premises liability and negligence.
Humphry alleged in the complaint that he suffered personal injuries on Nov. 11, 2020, when he was walking on the sidewalk along the AM Mini Mart gas station located on Homestead Road in Houston, and tripped and fell on a "large crack" on the concrete. Specifically, Humphry claimed he suffered injuries to his back, right hip, left hip, left foot and other parts of his body; and that there were no "warning" or "caution" signs posted in the area. Humphry alleged negligence on the part of AM Mini Mart for failing to maintain its premises in a "reasonably safe condition." He also claimed the defendant "knew or should have known" of the "unreasonably dangerous condition" and failed to warn of the alleged hazard.
The complaint stated that Humphry seeks monetary relief between $200,000 and $1 million, interest and all other just relief. He is represented by Jesus Salinas of The Daspit Law Firm in Houston.
