Elderly woman allegedly fell on metal landscaping at Houston apartment complex

HOUSTON — An elderly woman claims she suffered severe injuries after allegedly falling at her Houston apartment complex and striking her head on metal landscaping.

Linda Vandagrift filed a complaint Jan. 25 in Harris County District Court against Cortland Partners LLC, Lakefront Villas GP LLC, Lake Front Villages GP LLC frequently known as Newport On The Lake and others alleging negligence. 

Vandagrift, who was 81 years old at the time, alleges in her complaint that on Feb. 8, 2019, while checking the mailbox at her apartment complex, she fell and "landed forcibly on metal landscaping" and struck her head. 

Vandagrift claims she suffered severe and permanent injuries including the inability to do her ordinary tasks, disfigurement, pain and mental anguish as well as lost wages and medical bills. In addition she claims in her suit that her injuries were caused by defendants' negligence in allowing the dangerous condition to exist and for failing to warn of the hazard the metal landscaping that posed an "unusually high risk" where individuals walked. 

Vandagrift seeks monetary relief between $250,000 and $1 million, interest and all other just relief. She is represented by Jeffrey Todd of The Todd Law Group PLLC in Houston.
