Man claims he slipped on water leak at Houston Kroger, sues for $250K

HOUSTON — A man is claiming a refrigeration water leak on the aisle at a Houston Kroger caused him to suffer a serious shoulder injury that required surgical treatment.  

John Shindler filed a complaint March 18 in Harris County District Court against Kroger Texas LP alleging negligence. 

Shindler claims in his suit that while shopping at the Kroger on Briar Forest Drive in Houston on May 5, 2020, water allowed to leak from a refrigeration unit into the aisles. He alleges as a result of the "dangerous condition," he suffered a "major shoulder injury" and required surgery. 

Shindler also alleges Kroger's negligence for failing to keep the premises in a reasonably safe condition and for failing to warn of the hazard. He claims Kroger knew or should have known the dangerous condition existed and posed a risk of harm to him and other customers. 

Shindler seeks monetary relief of at least $255,000, interest and all other just relief. He is represented by Craig Muessig of The Law Offices of Craig Muessig in Baytown.
