Injured worker claims construction site was not properly staffed

HOUSTON — A worker clearing debris at a construction site in Dayton has filed a work injury case against a Cleveland, Texas construction company.

Frank Harrell filed a complaint  April 5 in Harris County District Court against Guy Nicholson, individually and doing business as Weston Construction alleging negligence. 

Harrell alleges in his complaint that he suffered "serious personal injuries" while working on clearing a debris field in Dayton on Dec. 16, 2019, and that the defendant is a "non-subscriber to worker's compensation." 

He claims the defendants neglected to properly secure and maintain the equipment used at the construction site and failed to have the site properly staffed. Harrell also claims the defendants failed to provide training or have proper safety policies in place as well as failed to provide emergency medical care. He also alleges the defendants violated regulations and standards of the Occupational Safety and Health Administration.

Harrell seeks monetary relief of more than $1 million and $10 million, trial by jury and all other just relief. He is represented by John Sheppard, Nicholas Morrow, Daniel Sheppard, Alexander Hughes and Joshua Daws in Houston.
