Golf Club of Houston faces suit over member's deposit refund

HOUSTON — The Golf Club of Houston is facing a suit from a former member who claims he was not issued a membership deposit refund per his membership agreement. 

Timothy Martin filed a complaint April 27 in Harris County District Court against Escalante GCOH LLC doing business as Golf Club of Houston, Escalante Golf LLC and Escalante Golf Holdings Inc., alleging breach of contract, unjust enrichment, fraud, conspiracy to commit civil theft and violation of the Texas Deceptive Trade Practices Act and Texas Theft Liability Act. 

According to his complaint, Martin joined the Golf Club of Houston in Humble on Jan. 27, 2004, and paid a $28,000 membership deposit. He alleges the membership agreement with the Golf Club of Houston allowed for a refund of 50% of a membership deposit after four or more years of membership. Martin claims in August of 2018, he resigned his membership and has not received his deposit membership despite attempts to resolve the matter including signing a second resignation form in May of 2019. 

Martin seeks monetary relief of at least $250,000, interest, trial by jury and all other just relief. He is represented by Andrew Scott of Gordon & Rees LLP in Houston.
