HOUSTON — A former Justgo Supermarket worker who fell off a ladder and suffered injuries that left him incapacitated is claiming the company's negligence.

Carlos Gutierrez filed a complaint May 3 in Harris County District Court against Justgo Group Inc.m and SL & FCS LLC alleging negligence.

Gutierrez was working at the Justgo Supermarket on Highway 6 in Sugar Land on Jan. 2, 2020, according to his complaint. He claims that while he was on a ladder stocking the store shelves, the ladder "was not properly secured" which caused him to fall "many feet to the ground." Gutierrez alleges he suffered "severe" injuries that left him incapacitated and that the defendants were negligent in failing to keep a proper lookout for his safety. He further alleges the defendants were negligent for failing to provide him with proper safety equipment, failing to properly train its employees and failed to implement and enforce proper safety procedures and policies.

Gutierrez seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Jordan Glaze and Josh Garrett of Glaze Garrett in Gilmer.
