Welder suffers back, neck injuries from lifting steel plates, suit claims

HOUSTON — A welder claims he suffered serious back and neck injuries due to repeated lifting and carrying of steel plates while working aboard a vessel. 

Alberto Camarillo filed a complaint May 11 in Harris County District Court against Westport Orange Shipyard LLC, Kirby Corporation and Kirby Inland Marine LP alleging negligence. 

According to Camarillo's complaint, he was working as a welder for Westport at its shipyard in Orange. He claims while working on a vessel which was owned by Kirby, he had to lift and carry steel plates "repetitively" and did not have proper safety equipment or personnel which caused him to injure his back and neck. Carmarillo alleges he has required "extensive" and "ongoing" medical treatment for his injuries and that Westport was a non-subscriber under the Texas Workers' Compensation Act. 

He claims the defendants failed to put in place safety protocols or to train its employees. Camarillo further claims the defendants failed to warn of the dangerous conditions at the work site and to maintain a safe working environment that is "free of known hazards." 

Camarillo seeks monetary relief of more than $1 million, interest and trial by jury. He is represented by Kurt Arnold, Kyle Findley, John Grinnan and Adam Lewis of Arnold & Itkin LLP in Houston.
