HOUSTON — The wife and children of a Pulice Construction foreman who was run over and killed by a front loader while on a job site is claiming the company's negligence.
Rebeca Matamoros, individually and as representative of the Estate of Isidro Matamoros, deceased, Juana Matamoros, Mayra Tristan, Sindia Matamoros, Elizabeth Matamoros and Marlene Matamoros filed a complaint May 26 in Harris County District Court against Pulice Construction Inc., alleging negligence and wrongful death.
The plaintiffs allege that Isidro Matamoros' life was "drastically cut short" after suffering fatal injuries when he was run over by a Caterpillar front loader tractor. According to the complaint, Matamoros was working as a foreman for Pulice Construction on March 3, 2021, at a construction site in Houston.
They allege Matamoros was talking to one of his supervisors on his cell phone in the area where a Pulice employee was operating the Caterpillar. They claim the Caterpillar operator "recklessly shot the tractor in reverse" and into the street where it struck Matamoros and caused him to be thrown to the ground as the tractor continued backward and ran directly over him. The plaintiffs allege the defendants failed to properly train and supervise its employees or adequately control the worksite and ensure safety standards.
The plaintiffs seek monetary relief of more than $1 million, interest and all other just relief. They are represented by Benny Agosto, Jr., and Ben Agosto, III of Abraham, Watkins, Nichols, Agosto, Aziz & Stogner in Houston.
