Woman falls on uneven brick pavers in movie theater parking lot, sues for $1M

HOUSTON — A woman who fell on uneven brick pavers in the parking lot of a Houston movie theater and suffered injuries is claiming negligence. 

Sylvia Palacios filed a complaint June 7 in Harris County District Court against Levcor Inc., and ISS facility Services Inc., alleging negligence. 

Palacios, according to her complaint, was at the Marq-E- Entertainment Center on Katy Freeway in Houston on Jan. 4, 2020, attending a movie at Edwards Theater. She claims that while walking back to her vehicle after the movie, she stepped on a section of "uneven and unstable" brick pavers which caused her to stumble and fall and suffer serious injuries. 

Palacios also claims she suffered lost wages and incurred medical expenses as a result of the fall and that the defendants were negligent in failing to maintain their premises. She alleges the defendants failed to inspect and correct the hazard or inform those coming onto their premises about the dangerous condition. 

Palacios seeks monetary relief between $250,000 and $1 million, interest, and all other just relief. She is represented by Brian Merka and Benjamin Kennedy of Kennedy & Merka PLLC in Houston.
