Worker's ear sliced by falling gate on TxDOT property claims negligence

HOUSTON — A pallet supply company employee working on a Texas Department of Transportation property had his ear sliced after a gate fell on top of him as he was exiting the property. 

Eduardo Guelmes Naranjo filed a complaint June 24 in Harris County District Court against Four-Way Pallet Company LLC and the Texas Department of Transportation frequently known as State Department of Highways & Public Transportation alleging negligence. 

According to his complaint, Naranjo was employed by Four-Way Pallet and was working at a property located on Eastex Freeway in Houston that the company was leasing from the Texas Department of Transportation. He claims as he was leaving the property through a gate, the gate became unstable, fell on top of him and caused him to be pushed to the ground and his ear to be sliced. 

Naranjo also claims he suffered other bodily injuries that caused physical impairment and disfigurement and required medical treatment. He alleges the Texas Department of Transportation's negligence for failing to properly inspect and keep its premises in a reasonably safe condition or warn invitees of the dangerous condition. He further alleges Four-Way failed to provide him with a safe work environment and acted with "reckless disregard" for the safety of its employees. 

Naranjo seeks monetary relief, interest and all other just relief. He is represented by Richard Paxton of the Paxton Law Firm in Houston.
