Suit: Unsecured door removed by Lowe's delivery contractor falls on homeowner's hand

HOUSTON — A woman allegedly suffered a fractured hand when the front door of her home was taken off its hinges by a Lowe's delivery contractor and not properly secured. 

Mallory Carabajal and Antonio Jasso filed a complaint July 19 in Harris County District Court against XPO Logistics Inc., also known as XPO Logistics LLC, XPO Last Mile Inc., doing business as XPO Logistics and Lowe's Home Centers LLC and John Doe.

The plaintiffs allege in their complaint that XPO was delivering the new refrigerator they had purchased from Lowe's on July 19, 2019. They claim that XPO employees removed their front door in order to place the refrigerator inside their home and then propped the "heavy" door upright inside the house. 

The plaintiffs allege that door fell and struck Mallory Carabajal on her hand and caused her to suffer a hand fracture and also caused the glass panels to shatter. The plaintiffs futher allege the door damage left their home susceptible to weather damage, home invasion and loss of energy through heating and cooling. The plaintiffs claim the defendants did not properly secure the door they had removed from its hinges which created a hazard. 

The plaintiffs seek monetary relief of $250,000 or less and all other just relief. They are represented by Alex Moheb of Moheb Law PLLC in Houston.
