Former manufacturing company exec alleges he is owed $31,000 sales commission

HOUSTON — A former AFGlobal executive alleges he was fired because of his age and that he is owed a more than $30,000 sales commission for a $5.98 million gas turbine order that took place while he was still actively on the payroll. 

Christean Kapp filed a complaint Aug. 6 in Harris County District Court against AFGlobal Corporation, Allpoints Oilfield Servcies LLC and Airem Energy LLC alleging age discrimination, breach of contract. 

Kapp began working for AFGlobal as vice president of compression, energy solutions on Oct. 3, 2018, according to his complaint. He claims his "written offer of employment" included a compensation plan, bonus and incentive plan, vacation allowance and participation in an employee benefit plan. Kapp, then age 59, alleges that in March of 2020, his job was terminated due to a "reduction-in-force" and that at that time, a $5.98 million order with Goldsmith, Texas processing plant for gas turbines had been complete. 

He claims the turbine order carried as a "as-sold gross margin of 20%" and that he is entitled to a $31,000 commission and that he was still actively on the payroll at the time of sale. Knapp alleges the defendants have refused to pay him the commission in breach of his employment contract and that his age was a "motivating factor" in his job termination.

Kapp seeks monetary relief between $250,000 and $1 million, interest and all other just relief. He is represented by Robert Filteau and Jon Sullivan, III of The Law Offices of Filteau & Sullivan LTD LLP in Houston.
