Man claims truck was totaled after falling off lift at brake repair shop

HOUSTON — A Brake Check in Tomball is facing a suit from a customer whose truck fell off a lift while it was being serviced and was totaled. 

Sam Medrano filed a complaint Aug. 18 in Harris County District Court against Brake Check Inc., alleging negligence. 

Medrano took his vehicle to Brake Check on SH 249 in Tomball on July 3, 2020, to service his truck, according to his complaint. He alleges that while his car was at Brake Check, it fell off a service lift and was "deemed a total loss." Medrando claims as a result of the damage to his work truck, he incurred economic damage and mental anguish. He also claims Brake Check's negligence for failing to use a "degree of care that a reasonably careful person would use" and for failing to properly secure the truck to the lift. 

Medrano seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Attorney Kelly Joseph in Houston.
